Where to set up /Buy or rent? /Renting a farm in France
Written or verbal lease
Written lease

Privately signed deed: a deed drawn up freely and signed on unmarked paper by the parties, without intervention by the notary.

It is drawn up in three original copies and may be registered at the Tax Office (within a month from date of signature of the lease). 


Registration is not obligatory but means that:

- an exact date is put on when the lease comes into effect, 

- one can benefit from reduced rates when making acquisition of this property at a later date.

Officially recorded deed:deed drawn up by a notary (obligatory only for leases of longer than twelve years).

Standard leasesare available at Chambers of Agriculture, at ADASEA, SAFER and Management Centres.

Good to know

You must perform an inventory before signing the lease. This must be done in the presence of both parties and at joint expenses at the latest within three months after the tenant has taken possession.

Verbal lease

This has the same effects as a written lease, but a written lease shows proof of the existence of a lease in case of dispute.

Good to know

In this case, payment of tenancy charge should be made preferably by cheque to prove that payment is being made.

You can declare a verbal lease to the tax office, in order to claim the reduced rate in case of purchase as the farmer.
