A lease may not be forless than 9 years. (Except in some specific cases).
The “ordinary” rural lease therefore lasts for a minimum of 9 years, with the possibility of renewal automatically).
The long-term lease
You can sign a lease for a period of more than 9 years.
This is a long-term lease if it lasts for a minimum of 18 years.
The co-tenant
As the farmer in place you can associate a "co-tenant" with the lease to facilitate your succession.
There are three types of long-term lease:
18-year lease,at least, renewable for a further 9 years, except if the owner takes back the land to farm it himself.
25-year lease,which, at term, is renewed by one year periods with a notice period of 4 years, and with no particular reasons for termination (“constant” notice period leases).
Career lease This lasts for at least 25 years. It means that the land can be farmed until retirement age.
The lease confers a right in rem.
Benefit of the property is granted by the owner for a period of between 19 and 99 years.
What is a "co-tenant"?
As the farmer in place you can associate a "co-tenant" with the lease.
This can be: - either your spouse (husband or wife) - or an adult descendant. For this you must obtain the owner’s agreement.
The lease is then drafted in the names of the tenant and the co-tenant and signed as such by the parties.
Interest: security in case of death of the tenant.
